Your order for purchase constitutes your "offer" which shall be subject to the terms and conditions as listed below. Smartbuyz.co.in website has the right to accept or reject your offer without assigning any reason thereof.

2. SMARTBUYZ.CO.IN acts only as a facilitator to facilitate transactions between you (the User) and vendors through its Smartbuyz.co.in. SMARTBUYZ.CO.IN, its directors, officials, representatives and employees shall in no way be held responsible for any losses, expenses, quality of products or services, damages and/or taxes incurred by the Users in the use of the facility.
3. The services of Smartbuyz.co.in are provided on an "as is" basis at the User’s sole risk without warranties of any kind, whether express or implied. SMARTBUYZ.CO.IN, it’s directors, employees, agents, affiliates, consultants, contracted companies make no warranties of any kind, whether expressed or implied, for the service it is providing or as to the results that may be obtained from use of the service, or as to the accuracy, reliability or content of any information, service, or merchandise provided through this website. SMARTBUYZ.CO.IN does not represent or warrant maintaining the confidentiality of information, though our practice is to make reasonable efforts to maintain such confidentiality. It is also clearly understood that all warranties, implied or express, take place between the vendors and the User.
4. SMARTBUYZ.CO.IN will not be responsible for any damage suffered by users from use of the services on Smartbuyz.co.in. This without limitation includes loss of revenue or data resulting from delays, non-deliveries, missed deliveries, or service interruptions as may occur because of any act / omission of the vendor. This disclaimer of liability also applies to any damages or injury caused by any failure of performance, negligence, defect, deletion, error, omission, interruption, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, tortuous behavior, or under any other cause of action.
5. SMARTBUYZ.CO.IN's Vendor Merchant Partners will take "Full Responsibility" of your Order, if the Order has been shipped to any of the major cities, where they have used "Private Courier Companies" (eg. Blue Dart, First Flight, AFL, DTDC, DHL etc.) to ship your order.
Thus SMARTBUYZ.CO.IN request you (the User) to make sure before placing their order for Interior Locations / Country Side / Rural Area Addresses are serviced properly by Indian Postal Service and if not, then we insist that they should not place their orders for such locations to avoid dissatisfaction.

7. The prices and availability of products are subject to change without prior notice at the sole discretion of SMARTBUYZ.CO.IN.
8. Request for cancellations of orders once placed on Smartbuyz.co.in shall not be entertained.
9. SMARTBUYZ.CO.IN reserves the right to refuse or cancel any order placed for a product that is listed at an incorrect price or for any other reason. This shall be regardless of whether the order has been confirmed and/or payment been received. The payment shall be refunded and the User shall be informed of the same.
10. If a non-delivery or late delivery occurs due to a mistake by the User (i.e. wrong or incomplete name or address or recipient not available) any extra cost spent by SMARTBUYZ.CO.IN for re-delivery shall be claimed from the User placing the order.
11. The User agrees to give accurate, authentic and true information. SMARTBUYZ.CO.IN reserves the right to confirm and validate the information and other details provided by the User at any point of time. If any such User details are found not to be true wholly or partly, SMARTBUYZ.CO.IN has the right in its sole discretion to reject the registration and debar the User from using the services of Smartbuyz.co.in and / or other affiliated websites without prior intimation whatsoever.
12. SMARTBUYZ.CO.IN will not be liable for any type or kind of credit card fraud. The liability to use a card fraudulently will be on the user and the onus to 'prove otherwise' shall be exclusively on the user. The User must exclusively use his/her own card on the site.
13. SMARTBUYZ.CO.IN shall not be liable for any delay/non-delivery of ordered goods by the vendors (trade organizations, manufacturers / shops etc.), flood, fire, wars, acts of God or any cause that is beyond the control of SMARTBUYZ.CO.IN
14. The User agrees to use the services provided by Smartbuyz.co.in, SMARTBUYZ.CO.IN, its affiliates, consultants and contracted companies, for lawful purposes only.
15. The User certifies that he/she is at least 18 (eighteen) years of age or has the consent of a parent or legal guardian.
16. SMARTBUYZ.CO.IN shall not entertain any complaints after 15 days, once the order is delivered.
17. This agreement shall be construed in accordance with the applicable laws of India. The Courts at Ahmedabad shall have exclusive jurisdiction in any proceedings arising out of this agreement.
18. We as a merchant shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of authorization for any Transaction, on Account of the Cardholder having exceeded the preset limit mutually agreed by us with our acquiring bank from time to time
RETURN/ REFUND
Cancellation of Order by User
Cancellation of order within 6 hours without penalty, except the 4% Bank Charges
After placing an order, customer can only cancel the order if the order state is showing as "pending" under Order History. Cancellations have to be made within (maximum) 6 Hours of placing an order. For canceling your order, you will have to get in touch with our Customer Support Team by sending an email giving your Order Number.
General Scenario
In case we receive a cancellation e-mail and till that time the order has already been "processed" by us, the order cannot be canceled. Smartbuyz.co.in has complete right to decide whether an order should be cancelled or not. Also, the customer agrees not to dispute the decision made by Smartbuyz.co.in and accept Smartbuyz.co.in decision regarding the cancellation.
In case of Perishable Goods
In case if a customer wants to cancel the order for a perishable products, the cost of the products will have to be borne by them.
In case of Smartbuyz.co.inGift Certificate
Gift Certificate will not be canceled, user can demand for extension of expiry date within 3 days of purchase.
Cancellation of Order by Smartbuyz
Smartbuyz reserves the right to refuse or cancel any order placed for a product that is listed at an incorrect price or for any other reason. This shall be regardless of whether the order has been confirmed and/or payment been received. The 100% payment shall be refunded and the User shall be informed of the same.
If a non-delivery or late delivery occurs due to a mistake by the User (i.e. wrong or incomplete name or address or recipient not available or any other related reason) any extra cost spent by smartbuyz for re-delivery shall be claimed from the User.

Replacement/ Return Policy by smartbuyz
In 7 days except the following:
1. Products perishable in nature
2. Gift Certificates
3. Items that have been used or opened
4. An item not returned in the condition it was received.
5. Any item received by us in a damaged condition.
6. Items sourced or delivered outside India.
7. Jewelry [ with exception if the product is not the same as ordered or any manufacturing defect ]
8. Electronics and Mobiles [ with exception if the product is not the same as ordered or any manufacturing defect ]
We take stringent measures to ensure that the items delivered to you are in perfect condition. However, there is a remote possibility that:
· the item may be damaged during transit
· or there might be a manufacturing defect
· or that a wrong item is delivered to you
In only such cases as given above, we will replace the item at no extra cost, provided that the request for replacement / return of item is made within the stipulated time-frame as given below. No returns or replacements will be allowed after the order is processed, except for the reasons given above.
To get a replacement, email us your Order Number and the Reason for returning. Only after receiving our confirmation for the return, you are requested to send the item back to us.We will then arrange for the replacement of the item through our logistics partner. We shall not be responsible for any items sent to us for return / replacement without our confirmation.
Our Return Policy:
· Replacement request must be made within 7 days of purchase and must not be part of above list
· There are no extra shipping charges for the delivery of replacement items for the reasons mentioned above.
· In case of a replacement, our logistics partners will attempt delivery of the items thrice. In case the delivery is not executed during all the three attempts, due to recipient not available / premises locked, etc., the customer shall still be charged for the order.
· In case of perishable items or custom-made non-perishable items, neither Smartbuyz.co.in nor our enabling partners will be able to accept any returns or replacement of such items.
Refund Policy by smartbuyz
Cases of goods unavailability or service problem:
· If the item sent for replacement is not available, we will try to give you best possible alternatives, but at the end choice of customer will be final
· If the order is confirmed by us and our vendor is not able to ship the product on time, then we give refunds to customer, if customer demands
· 100% refund will be given, if product is not available or vendor is not able to ship the products
· For courier products, If the delivery address is out-side the service area, then only 100% refund will be given
Cases of customer demanding refunds:
· Refund will be 90% of Order Cost, in case of customer don't want suitable and available replacement of product
· In express-orders only 90% refund will be given, If the delivery address is out-side the service area
